These terms apply to use of motionperformance.com.au and online purchases from Motion Performance Exhaust Centre. References to “we”, “us” and “our” mean the business operating under that registered name.
Consumer rights
Nothing in these terms excludes or restricts a right or remedy that cannot lawfully be excluded, including Australian Consumer Law rights. Those rights take priority over any inconsistent wording in these terms or our other policies.
Product information and suitability
We aim to provide accurate descriptions, specifications, fitment information, prices and availability. Check the product part number and your vehicle details before ordering. If you are unsure, contact us with the make, model, series, year, engine and relevant modifications.
Product photographs may illustrate an application or configuration. Where a photograph is representative, the product description should identify this. We remain responsible for supplying goods that match their description and any suitability representations we make.
Prices, payment and orders
Prices are displayed in Australian dollars. Applicable taxes and shipping charges are shown before payment. Payment is required before dispatch unless we agree otherwise.
An automated order acknowledgement confirms receipt of your order. If we discover a genuine pricing error, an unavailable product or another problem affecting fulfilment, we will contact you promptly. We will not substitute a product or charge a higher amount without your agreement. If we cannot fulfil the order on agreed terms, we will refund amounts paid for the unfulfilled goods and associated delivery charges.
Changes to advertised prices do not retrospectively change the price of an accepted order.
Delivery, cancellations and returns
Our Shipping & Delivery Policy explains handling, freight and delivery arrangements. Our Refund & Returns Policy explains change-of-mind eligibility, exclusions, fees and statutory remedies.
Contact us promptly if you want to amend or cancel an order. We will explain what is possible based on its progress and any agreed custom or special-order arrangements. We will not apply a cancellation charge that has not been disclosed and agreed or that is inconsistent with your legal rights.
Installation and performance products
Performance, exhaust and engine-management products may require professional installation, setup or tuning. Follow the manufacturer's instructions and confirm suitability for the intended application.
Some products are intended for competition or off-road applications. Do not assume that a product is road legal simply because it is available for sale. Confirm applicable vehicle, emissions and registration requirements before installation.
Damage caused by misuse, incorrect installation or unsuitable modification may not be covered by a manufacturer warranty. This does not remove rights for an unrelated defect or a failure for which we are responsible.
Warranty and support
Contact us if a product we sold develops a problem. Manufacturer warranties are additional to consumer guarantees and do not replace them. We may arrange technical assessment with a supplier or manufacturer, but you do not have to pursue the manufacturer instead of us to exercise rights against us.
Workshop services
Workshop work, tuning and fabrication are subject to the scope, pricing and timing agreed for the particular job. We will seek agreement before undertaking additional chargeable work. Consumer guarantees applying to services remain in place.
Website use and intellectual property
Do not use this website for unlawful activity, interfere with its operation or attempt unauthorised access. Website materials are owned by us or used with permission from their owners. Supplier names and trademarks identify the relevant products and remain the property of their owners.
Privacy and changes
Our Privacy Policy explains how we handle personal information. We may update these terms for future use and purchases. Updates do not retrospectively remove rights arising from an earlier order.
